While damages incurred in Germany generally remain within the relationship between the injuring party and the injured party and, if necessary, must be compensated by the manufacturer as the injuring party, all accident-related personal injuries in New Zealand have been compensated since 1974 by a no-fault accident compensation system that does not seek recourse from the injuring party. The author presents both systems, analyzes their basic structures, strengths, and weaknesses, and develops solutions for improving existing deficits.
