Artificial Intelligence, in the form of social or chat bots, is evolving into a communications partner for humans and at the same time creating remarkable artwork. Against this background, Amelie Rossipaul examines the question of AI’s legal status. With reference to the constitutional right to freedom of expression and artistic freedom, this status is first outlined in terms of constitutional rights theory and then based on concrete cases of application.
