While foreign direct investment is still dominated by larger multinational enterprises (MNEs), cross-border investment activities by small and medium-sized enterprises (SMEs) are becoming increasingly relevant. Julian Kimmerle asks whether current international investment law provides an adequate normative framework for the internationalization of SMEs. Finding that although the law's substantive rules do accommodate the structural problems SMEs face when investing abroad, under the lex lata, they are still often prevented from accessing investment arbitration due to their limited resources. By considering current reform efforts, the volume develops practicable approaches to overcome this shortcoming.
