Directive 2019/1023 on preventive restructuring frameworks enables financially stressed enterprises to subject (substantially) all creditors to a common scheme in order to prevent hold out-strategies and, thereby, preserve going concern value. Given the lack of conflict of laws provisions in the Directive itself, Fabian Kratzlmeier assesses the international scope of these new restructuring frameworks and their coherence with the existing set of cross-border legislation on the EU level, in particular the European Insolvency and BrusselsIbis regulations.
