The law can only protect citizens from the legal wrongdoings of others in so far as the facts of a case can be clarified. If the principle of disclosure is set out in such a way that it prevents clarification, citizens are effectively deprived of their rights vis-a-vis third parties. Alexander Morrell is therefore in favour of an interpretation of the principle that encourages clarification, protects secrets, fits well into the procedural system, and also eliminates old inconsistencies. If this were to be recognised, it would become less attractive to violate the rights of others in the future.
