Simon Horn identifies a vis attractiva contractus; that is, a spillover effect whereby contracts project themselves into the non-contractual sphere. His study analyses this effect and concludes that it would be desirable to return to an understanding of contract that is functional in terms of material scope and relative as regards personal scope.
