English summary: Gabriel Nogueira Dias gives a systematic description of Hans Kelsen's theory of law, which is probably the most polished theory of law in the German-speaking world. He begins his detailed study by differentiating between Kelsen's positivist theory of law and his general theory of law. Based on this differentiation, the author is able to make the essential characteristics of Kelsen's entire work more understandable. He shows that both constancy and variety are to be found in Kelsen's legal thinking, depending upon which facet of his entire work in the field of law is being considered. In addition to distinguishing between the two theories, the author also sheds new light on the essential interaction between Kelsen's positivist theory of law and his general theory of law.


German description: Gabriel Nogueira Dias stellt die im deutschen Sprachraum wohl ausgefeilteste Theorie des Rechts, die Rechtstheorie Hans Kelsens, systematisch dar. Um dieses Vorhaben ausfuhrlich zu realisieren, bedarf es zunachst einer Darstellung des rechtspositivistischen Projekts Kelsens. Sodann gilt die Aufmerksamkeit seiner Allgemeinen Rechtslehre, die sozusagen als seine tatsachlich strukturierte Rechtsbetrachtung fungiert. Ausgehend von dieser Trennung von rechtspositivistischem Projekt einerseits und Allgemeiner Rechtslehre andererseits gelingt es dem Autor, die essentiellen Merkmale des gesamten Werkes Kelsens fassbarer zu machen. Einerseits zeigt sich im Ergebnis, dass Konstanz und Varietat gleichermassen im Rechtsdenken Kelsens zu finden sind, je nachdem, welche Facette seiner rechtswissenschaftlichen Gesamtleistung in Betracht gezogen wird. Andererseits ermoglicht es diese differenzierte Erforschung des gesamten Theorie-Gebaudes Kelsens, die unentbehrliche Interaktion zwischen Kelsens rechtspositivistischem Projekt und seiner Allgemeinen Rechtslehre zu erhellen.
