English summary: Is it possible to hold greenhouse gas emitters liable for damages as a consequence of climate change? In light of the recently inflamed climate change litigation, Erik Pottker compares the (Climate-) liability law of Germany and the United States of America. Standards are therefore the guarantee of maximum property protection for individuals and an economically, as well as an ecologically, sensible influence over the behavior of emitters. The focus of the investigation presents the two determinants of liability law, causality and the liability for the violation of obligations. The study also tests the standards found in liability law for just remuneration and the assignment of responsibility, even in the case of complex organizations which are typical for modern society. The analysis ends in a commentary on whether a liability law based form of climate protection is desirable and practical.

Aus Anlass der jungst entflammten climate change litigation vergleicht Erik Pottker das (Klima-)Haftungsrecht Deutschlands und der Vereinigten Staaten von Amerika. Massstabe sind dabei die Gewahrleistung maximalen Individualrechtsguterschutzes und eine okonomisch wie okologisch sinnvolle Verhaltenssteuerung. Den Schwerpunkt der Untersuchung bilden die beiden Determinanten des Haftungsrechts, die Kausalitat und das Pflichtwidrigkeitserfordernis. Gepruft wird dabei nicht zuletzt der Gerechtigkeitsgehalt des haftungsrechtlichen Normenbestandes bezuglich der Verantwortungszuweisung auch in komplexen Strukturen, wie sie fur moderne Gesellschaften typisch sind.
